Wellington waterfront housing consent quashed by Court of Appeal

The council approved the major development at Shelly Bay, but was thrown out by the Court of Appeal.

Resource consent for a large housing development on prime waterfront land in Wellington has been quashed by the Court of Appeal.

The Shelly Bay development was approved by Wellington City Council for 350 dwellings, a hotel and an aged care facility.

The court ruled the council didn't follow the law by not giving enough consideration to environmental and heritage impacts.

The council has been ordered to re-evaluate the application.
