Home detention sentence handed down to Rouxle Le Roux for killing boy, 15, will not be appealed by Crown Law

Charlene Kraatskow has started a petition, calling for a harsher penalty for driver Rouxle Le Roux.

The Crown will not appeal the home detention sentence given to Rouxle LeRoux, who killed a 15-year-old cyclist in a drunken hit-and-run in Auckland, his mother Charlene Kraatskow said.

"Yes, we have been told," Ms Kraatskow said about the Crown decision.

"We are disappointed but just want to focus on our other children now and getting through the first Christmas without Nathan."

Ms LeRoux had smoked cannabis and drunk wine earlier that day before she crashed her Mercedes into the 15-year-old, who was riding a small bike, in May.

Rouxle Le Roux was sentenced to home detention over Nathan Kraatskow’s death in May.

Nathan died at the scene and Le Roux failed to stop, turning herself into police the following day.

The 19-year-old was sentenced at Auckland District Court on Friday to 11 months’ home detention and 250 hours of community work for dangerous driving causing death.

A petition started by Nathan's parents calling for a harsher penalty for Ms LeRoux was signed by 159,559 people and counting - just under the population of Hamilton - in comparison.

"The Deputy Solicitor-General (Criminal) has reviewed this matter, as well as two other counsel within Crown Law," it said on a statement.

"The matter has been treated with urgency, in order to give the victim's family an answer before the Christmas break.

"We consider the sentence imposed on Ms Le Roux was appropriate in all of the circumstances of the case, and there is therefore no basis for an appeal. The Police advised the victim's family of the decision this morning."
